Brightway (SC Inspire Business Solutions SRL) is a training and business consulting company that offers organizations personal development and performance development programs. We organize very practical courses that take the form of interactive simulations, where participants create strategies to solve the problems they face daily at work.

This information note refers to the personal data processing activities of SC Inspire Business Solutions SRL.

The information note regarding the personal data processing note applies to all personal data processing we carry out as well as to all interactions with our website hosted on www.brightway.ro.

SC Inspire Business Solutions SRL is a personal data operator and owner of the www.brightway.ro website.

  1. Our activity

We, at SC Inspire Business Solutions SRL, make every effort to provide our clients and partners with professional training, consulting and event management services.

In completing our services and in order to develop existing business relationships or future relationships, we support and contribute to a better understanding of the legal framework and we are continually working to inform you about the economic issues, courses and training programs organized by us relevant to you and your business. In this regard, we organize events for clients, contacts and partners and send alerts, information, newsletters, analysis forms and other informative materials, both on our areas of expertise and interest, as well as on our activity (collectively  called "The Information Service").

  1. The personal data we process

The collection of your personal data is strictly limited to what is necessary in order to provide you with the highest quality experience regarding our services and the use of our website.

The personal data we process may include:

  1. basic data for identification such as name, surname, function for personalized training materials and

registration of participation in certain events;

  1. contact details such as physical address or, as the case may be, personal email address, phone number;
  2. bank account and other financial information that allows us to carry out any kind of contractual relationship when it exists.

Also, if you want to join our team, we will process the necessary data in the recruitment process, such as full name, email address, telephone number and mailing address, any other data that you bring to our knowledge through the application documents that you provide by applying directly on the website or via e-mail or by submitting them physically to our office.   1. How we collect personal data

We collect only the personal data you provide us voluntarily (in physical or electronic form) as well as information available from public sources:

– on the occasion of Brightway consultant-client interactions, conducted on the basis of a collaboration contract or in preliminary discussions, in the negotiation and preparation of such a contract;

– through our website, after signing up for one of the events / trainings organized by our company;

– when you contact us by e-mail, whether you are interested in our services or whether you are interested in being employed or contracted by our company or collaborating with it, and

– in the context of a meeting at a business event (for example, by exchanging business cards).

  1. Legal bases and processing purposes

Because you are entitled to know the purpose in which we process your personal data, we will inform you before processing your personal data for any purpose other than that for which you have entrusted your personal data.

Deploying the contractual relationship with clients

Based on the contract with you, as a customer of SC Inspire Business Solutions SRL, we will process all personal data you provide us, as well as any other data necessary for the exercise of the profession and the performance of the service, in accordance with contractual provisions.

Professional Communications

If you are a customer or have contacted us for a professional purpose, we process your personal data on the basis of your legitimate interest in transmitting specific Communications to you and your business, including invitations to our events.

When you subscribe to the Information Service (Newsletter or Member Account) directly through the website or other form of direct request, we will require your consent to the processing of personal data in order to be able to provide those services you have requested subscription.

Recruitment

We collect the necessary information in the recruitment process to assess whether you are suitable for a position within SC Inspire Business Solutions SRL and for the purposes outlined below in the dedicated section "Information on recruitment process". The processing of personal data in the recruitment process has as a legal basis the execution of a contract with you, this processing representing the pre-contractual phase.

We will also keep track of the people who participated in the evaluation processes and the reasons why they did not receive an offer or for which the offer was denied on our legitimate interest in order to make the recruitment process more efficient.

  1. Information on recruitment processes

You may apply for a position within SC Inspire Business Solutions SRL by using the dedicated section of our website, by e-mail or by submitting your application directly to our office.

When applying through the dedicated section of the website, we will ask for your full name, e-mail address, telephone number and mailing address, as well as a CV and cover letter whose format and content are completely up to you.

We will use your personal data on the recruitment process for:

– assessing whether you are eligible for a position within SC Inspire Business Solutions SRL,

– contacting you regarding your application,

– managing the recruitment process,

– contacting you about positions that become available later and for whom we believe you have the right professional profile, and

– having a clear evidence of any previous recruitment processes you have participated in and the reasons why you have not submitted an offer or for which the offer was denied.

  1. Storage time

If you have opted to receive communications regarding our services, we will store your data to provide you with this service for 3 years from your last interaction with us or our materials. Then, after this period, we will ask you again for your consent to continue to benefit from our information (Newsletter or Member Account).

If at any time you decide that you no longer wish to benefit from the Information Service (Newsletter or Member Account) and withdraw your consent, we will respect your decision and we will no longer process your personal data for that purpose.

The personal data collected in the recruitment process and used for the purpose of keeping record of previous recruitment processes are stored for a period of 10 years from the time you applied to SC Inspire Business Solutions SRL.

We will delete your personal data when it is no longer required for the purposes for which it was collected or when you withdraw your consent (if your data processing is based on consent), unless processing your personal data is required on the basis of legal provisions or if we are otherwise entitled to continue processing. We will also retain your personal data for an additional period of time if immediate deletion would require overwriting of our back-up and disaster recovery systems.

As a rule, we do not divulge or transfer your personal data to third parties. However, in cases where disclosure or transfer is necessary or if we are bound by law, we will inform you as soon as possible of this transfer, unless the applicable law, including the rules governing the maintenance obligation of professional secrecy, prevents us from sending such information.

For personal data processing, we can use authorized individuals, for example, IT solutions vendors for business management, including financial accounting solutions, contact management solution providers, or conference organizers. With all the authorized individuals, we will sign personal data processing conventions with appropriate clauses to ensure that they assume obligations to process personal data (including their deletion) in full compliance with applicable laws and provide an adequate level of personal data protection.

All personal data is secure against threats and we ensure that they are protected by security measures and the appropriate IT infrastructure. Furthermore, we have implemented internal measures that allow us to discover, notify and document breaches of personal data security in the shortest possible time.

If we find a security breach of your personal data that poses a risk to your rights and freedoms, we will notify the National Supervisory Authority for Personal Data Processing. You will be informed of the security breach of your personal data if it leads to a high risk of your rights and freedoms.

You have the following rights regarding the processing of your personal data:

1. Right of access to personal data.

2. The right to obtain inaccurate personal data rectification.

3. The right to obtain restriction of processing of personal data. This right is available to you when:

a. challenge the accuracy of your personal data that we process;

b. processing of personal data is illegal,

c. we do not need your personal data for the purpose of processing, but you require them to be retained for the purpose of establishing, exercising or defending a right in court, or

d. you will oppose the processing of your personal data for as long as we verify the existence of our legitimate interest in the processing of your data.

We will analyze each request and will notify you of the actions taken in this regard as soon as possible but no later than one month after the filing of your application. If we need more information from you or have difficulty resolving your request, we will inform you without delay that we need extra time to properly analyze your request.

If you feel we have not resolved all your requests or are dissatisfied with our responses, you can file a complaint with the National Supervisory Authority for Personal Data Processing. You can also address the court.
